BACKGROUND:

 

The present Horizontal Property Regimes Act defines what constitutes an apartment in relation to condominiums.  Places that are separately delineated for the storage or moorage of a boat or plane are considered apartments within that definition.

 

The present law does not specifically authorize the development of storage facilities for motor vehicles as apartments. As a result, some title insurance companies have been unwilling to issue a title insurance policy on condominium type parking facilities.

 

SUMMARY:

 

The Horizontal Property Regimes Act is amended to include storage facilities for motor vehicles in the definition of apartment.

 

 

SUMMARY OF PROPOSED SENATE AMENDMENT:

 

It is the intent of the Legislature to improve and modify the present law pertaining to condominiums by incorporating provisions of the Uniform Condominium Act.  A statutory committee is created to review the Act, draft revisions, and report its recommendations to the Legislature.

 

Each unit in a condominium project must be described as to square footage and numbers of bathrooms, bedrooms, and fireplaces when the project declaration is filed in the auditor's office.
