BACKGROUND:

Current state law, RCW 70.105, gives the state preemptive authority to site and regulate hazardous waste facilities.  Proposals to convert existing facilities to hazardous waste facilities have prompted much local resistance to the state's preemptive authority in some communities.

SUMMARY:

The state will not have preemptive authority for hazardous waste incinerators built before 1987.
