BACKGROUND:
A gubernatorial appointee subject to Senate confirmation continues to serve unless rejected by a vote of the Senate. If rejected by the Senate, an appointee cannot be reappointed to the same position for a year after termination of service.
No time periods are prescribed within which the Senate must take action on an appointment.
SUMMARY:
An alternative is provided to continuance of service unless an appointee is rejected by the Senate.
If the Governor makes an appointment during an interim or within the first 30 days of a regular session and the Senate neither confirms nor rejects the appointee before the end of the same session, the person continues to serve the full appointment period as though confirmed.
The same time deadline is applied to Senate rejection of an appointment.
