BACKGROUND:

 

Current statute requires the counties to develop a comprehensive solid waste plan for the entire county whether or not the city intends to participate.  Efforts to implement these plans are sometimes difficult as the cities can opt out of the plan at any time.

 

In order to effectively and economically implement the state's new standards for landfills, and to achieve waste reduction and recycling, it may be necessary to give either a city or the county complete authority over solid waste management in that county or region.

 

SUMMARY:

 

Each county is to appoint a solid waste committee to recommend a comprehensive solid waste management plan for both the county and the cities in the county.  The plan will designate an entity, either a city or the county, to have complete authority for implementing the solid waste management plan.

 

The plan may be written to allow for the county and the cities in the county to share or divide the authority to manage, operate, and set rates for the necessary waste handling facilities.  However, no jurisdiction will be allowed to prepare an independent solid waste plan, or to operate and/or manage a solid waste facility unless authorized by the solid waste plan.
