Establishing priority in acquisition of agency surplus property for fire protection districts.

BACKGROUND:

 

The state or any municipality or subdivision thereof is authorized to dispose of real or personal property to the state or any municipality, subdivision thereof or the federal government.  Before surplus property of a value greater than $5,000 is disposed of, a hearing must be held.  Notice of the hearing must be published setting forth date, time and place of the hearing in a newspaper of general circulation.  A news release must also be disseminated.  No potential buyer is entitled to a priority to acquire any property sold by the state, municipality or a subdivision thereof.

 

SUMMARY:

 

Fire protection districts have priority to acquire surplus equipment of the state, a municipality or any political subdivision thereof.  The seller must publish a list of surplus equipment to be disposed of at least ten but not more than 20 days prior to disposition.  The list shall be published in a newspaper of general circulation in the area where the property is located.

 

Equipment which fire districts have priority to acquire includes, but is not limited to, trucks, radios, pumps, tractors and office equipment.
