                              SYNOPSIS AS ENACTED

 

BACKGROUND:

 

The Legislature created a "Housing Authority" in every city, town and county.  Before the Authority can transact any business or exercise its powers, the legislative authority of the city, town, or county must pass a resolution declaring the need for an Authority to function.

 

Some housing authorities, formerly activated, are no longer functioning or necessary (e.g., North Bonneville).  No statutory authority and procedure exists for the deactivation or abolishment of a Housing Authority.

 

SUMMARY:

 

A Housing Authority may be deactivated or abolished, after consideration of certain findings, by resolution or ordinance of the legislative authority of the city, town, or county.  The legislative authority is permitted to exercise power to complete the affairs of the Housing Authority.  The distribution of assets of an abolished or deactivated housing authority is specified.
