BACKGROUND:

 

Concern has been raised that the potential of personal liability for members of commissions and boards discourages interested citizens from being involved in such decision-making entities.

 

Currently, elected officials of special purpose districts are immune from civil liability.  The liability remains on the special purpose district itself.

 

SUMMARY:

 

The scope of the personal civil immunity is expanded to include appointed members and employees.  The entities covered by this immunity now include conservation districts.

 

 

EFFECT OF PROPOSED SUBSTITUTE:

 

Reference to employees is deleted.
