BACKGROUND:

 

It has been suggested that judges should have the authority to order driver's license revocation and that a longer revocation period be available in sentencing for convictions of serious vehicular crimes.

 

SUMMARY:

 

The court shall establish a period of driver's license revocation of not less than two years nor more than ten years when sentencing an offender convicted of vehicular homicide.  Licenses of offenders convicted of vehicular assault are revoked for a period of not less than one year nor more than five years.

 

If the court fails to establish a period of revocation, the Department revokes an operator's license for the statutory periods pertaining to vehicular homicide and vehicular assault.
