BACKGROUND:

 

Disabled persons may be physically unable to sign their name, but may be otherwise competent.  There is no clear legal direction for individuals in that situation to execute legally binding documents.  A limited guardian could be appointed for that purpose, but is expensive, time consuming, and sometimes not needed.

 

SUMMARY:

 

Otherwise competent persons who are physically unable to sign their name may orally direct a notary public to sign documents on their behalf.

 

In doing so, a notary public must be satisfied that the person making this request is physically unable to sign a name and is otherwise competent.
