BACKGROUND:
Some state agencies require employees to report contacts with state legislators to their supervisors. These contacts are required to be reported regardless of whether the contact was initiated by the state employee or by the legislator. It is suggested that all government employees--including those in local government--should have the right to contact or be contacted by legislators without being required to disclose the contact, unless they are attempting to lobby a bill.
SUMMARY:
State and local government employees have the right to contact or be contacted by state legislators without reporting the contact to the employer. They may, however, voluntarily report the contact. This right does not extend to lobbying activities required to be reported under the state Public Disclosure Act.
