BACKGROUND:

 

Several chapters in Title 16 RCW deal with trespass of livestock and livestock running at large in stock restricted areas.  These chapters include:  Chapter 16.04 Trespass of animals; Chapter 16.12 Swine, sheep, and goats at large; Chapter 16.13 Horses, mules, donkeys and cattle at large; Chapter 16.16 Stallions and jacks at large; Chapter 16.20 Bulls at large; Chapter 16.24 Stock restricted areas; and, Chapter 16.28 Estrays.  Much of the language in these statutes is repetitive, and some terminology is archaic and generally confusing.

 

SUMMARY:

 

The substantive language of the chapters in Title 16 RCW dealing with animals running at large is consolidated into Chapters 16.04 and 16.24 RCW.  Chapters 16.12, 16.13, 16.16, 16.20 and 16.28 RCW are repealed.

 

Under Chapter 16.04 RCW an owner of livestock will be liable for damages to another person's property caused by a trespassing animal.  Chapter 16.24 RCW sets forth the specific requirements for all livestock running at large, including those animals who may not run at large in open range areas.
