BACKGROUND:
The Public Works Assistance Account loans are made once each year, during the legislative session, with the approval of the Legislature. Because emergencies do not occur on any schedule, there is a need to set aside a portion of the Public Works Assistance Account that can be used in case of an imminent threat or a crisis to loan to the affected communities, for repairs to eligible public works.
SUMMARY:
A set-aside Assistance Account within the Public Works is allowed for emergencies. Loans made for an emergency situation do not have to be competitively bid. The funds may be expended without waiting for legislative approval.
EFFECT OF PROPOSED SUBSTITUTE:
The 5 percent appropriation limitation is added. An attempt to put these projects out to bid should be made. The reporting requirement is added.
