BACKGROUND:

 

Mobile home park operators who sell mobile homes within their lots are required to have an "established place of business," meaning a permanent enclosed commercial building and an improved display area of not less than 3,000 square feet to comply with all applicable local building codes, zoning and land-use ordinances.  They may not operate out of a single or multiple-unit dwelling house unless the ground floor is devoted to and occupied for commercial purposes.  Those who do not meet these requirements may be denied a mobile home dealer's license.

 

SUMMARY:

 

This bill would exempt mobile home park owners from the requirements regarding a permanent, enclosed commercial building, causing the business to remain open during normal business hours, furnishing a display area, compliance with local zoning and land-use ordinances, and the prohibition against conducting business in a dwelling house.

 

The Director of the Department of Licensing may grant waivers from any of the requirements for a mobile home park owner if compliance would cause undue hardship.

 

Finally, in cases where local government rules and state rules regulating licensing of mobile home dealers conflict, local government rules would prevail.
