BACKGROUND:

 

A recent litter survey conducted by the Department of Ecology indicates that 49.1 percent of all litter found on the side of Washington roads is the result of unsecured loads carried by vehicles.  When compared with other states, Washington's rate is about 10 percent higher.  This trend has remained steady for the last several years.

 

The State Patrol has had some difficulty enforcing the unsecured load law which requires only sand, gravel or dirt to be covered under most circumstances.  The law makes no mention of other types of materials that must be covered.  Because of this, the State Patrol and local law enforcement agencies have had a more difficult time preventing the exit of materials other than sand, dirt or gravel from vehicles.

 

SUMMARY:

 

Garbage, or other material susceptible to being dropped, spilled, leaked or otherwise escaping from a vehicle operating on a paved or unpaved public highway is to be covered.  A covering is not to be required if six inches of freeboard is maintained within the bed of the vehicle unless the State Patrol determines that the type of material in the vehicle needs to be covered to protect public health and safety.
