BACKGROUND:

 

The Juvenile Justice Act envisions the joint action of the Legislature and the Juvenile Dispositions Standards Commission in determining standards for sentencing juvenile offenders.  The Commission recommendations were presented to the appropriate standing committee of the Legislature which referred them back to the Commission for modification.  The Commission made no modifications.  The Legislature, in accordance with its authority, modified the standards submitted by the Commission.

 

SUMMARY:

 

Classifications for violations of the Uniform Controlled Substances Act are increased as follows:  (1) the category for a violation of the act with respect to narcotics is increased from classification B to B+; (2) the category for attempt, bail jump, conspiracy, or solicitation with respect to narcotics is increased from B to B+; (3) the category for a violation of the act with respect to non-narcotics is increased from C to C+; (4) the category for attempt, bail jump, conspiracy, or solicitation with respect to non-narcotics is increased from C to C+; (5) the category for sale of controlled substances for profit is increased from C to B; and (6) the category for attempt, bail jump, conspiracy, or solicitation for sale of controlled substances for profit is increased from C to B.
