AN ACT Relating to waste disposal; and adding a new section to chapter 36.70 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 36.70 RCW to read as follows:

          The operation of an incinerator or a landfill disposal facility in the unincorporated area of a county shall be a conditional use under this chapter and may be operated only pursuant to a permit issued by the county.  The permit may be subject to such conditions as the county finds necessary to protect the public health and the environmental quality of the area or to insure that the use is compatible with the proposed site and surrounding areas.  The issuance or denial of the permit or the imposition of conditions is subject to appeal to the county legislative authority.

          This section applies to both publicly and privately operated incinerators and landfills, but only to those incinerators and landfills that handle more than five tons of waste per year.
