AN ACT Relating to same-sex marriage; adding a new section to chapter 26.04 RCW; and declaring an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.     This act is necessary for the immediate preservation of the public peace, health, morals, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.

NEW SECTION. Sec. 2.  A new section is added to chapter 26.04 RCW to read as follows:

          A marriage license or certificate shall not be issued to any person desiring to marry any other person of the same sex.  Any marriage obtained outside the state of Washington of persons of the same sex shall not constitute a legal or valid marriage within the state of Washington and such persons shall not be considered, in law or otherwise, and for any purpose, as a legal spouse or as constituting a family.  Same-sex marriage is hereby declared to be against the public policy of the state of Washington.
