AN ACT Relating to solid waste; and adding a new section to chapter 70.95 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.95 RCW to read as follows:

          (1) The legislature finds that it is necessary to enhance the opportunities for waste reduction and recycling in order to effectuate the priorities of this chapter and thereby protect human health and the environment from inappropriate solid waste management which can result if the lower priorities of incineration and landfilling are implemented prior to achieving all feasible waste reduction and recycling.

          (2) After July 1, 1989, every person in Washington shall have the opportunity to recycle.  Within six months from the effective date of this section, each city and county that is required to adopt a comprehensive solid waste management plan shall identify the opportunities to recycle which may exist within its jurisdiction including those which exist on the effective date of this section and those which will be developed in the year following the effective date of this section.

          (3) For purposes of this section, "opportunity to recycle" means at least (a) a place for collecting source separated recyclable material located at or nearby a solid waste disposal facility and (b) in each city with a population greater than fifty thousand, collection at least once each month of source separated recyclable material from each person served by a solid waste collection service.  "Recyclable material" means any material that can be collected and sold for recycling at a cost equal to or less than the cost of collection and disposal of the same material.
