AN ACT Relating to grain dealers; and amending RCW 22.09.035.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 19, chapter 305, Laws of 1983 and RCW 22.09.035 are each amended to read as follows:

          (1) Except as provided in subsection (2) of this section, it is unlawful for any person to operate as a grain dealer in the state of Washington without first having obtained an annual license from the department.

(2) This chapter does not apply to a grain dealer ((that)) who is licensed for dealing in agricultural commodities under federal law.  The provisions of this chapter regarding grain dealers do not apply to a grain dealer who solicits, contracts for, or obtains during the licensing year from one or more producers title, possession, or control of agricultural commodities the total value of which commodities is less than one hundred thousand dollars.
