AN ACT Relating to polystyrene; adding a new section to chapter 43.19 RCW; and providing an effective date.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 43.19 RCW to read as follows:

          After the effective date of this section, no state agency may purchase or use any article or product which is constructed of or contains styrofoam or rigid, lightweight cellular polystyrene.

          Upon application by a state agency, the director of the department of general administration or the director's designee may waive in writing the provisions of this section if the state agency demonstrates a legitimate need to purchase or use the prohibited product or material and a reasonably adequate substitute cannot be found or is prohibitively expensive.

NEW SECTION. Sec. 2.     Section 1 of this act shall take effect January 1, 1989.
