AN ACT Relating to juvenile detention standards; and adding new sections to chapter 13.40 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The detention standards proposed by the juvenile disposition standards commission October 1, 1987, and submitted to the legislature pursuant to RCW 13.40.036, are approved and shall take effect thirty days after the effective date of this section.

 

          NEW SECTION.  Sec. 2.     (1)  The juvenile disposition standards commission shall propose to the legislature, no later than November 1st of each odd-numbered year, modifications to the standards approved under section 1 of this act.  If the commission fails to propose modifications to the detention standards, the existing standards shall remain in effect and may be adopted by the legislature or referred to the commission for modification as provided in subsection (2) of this section.  If the standards are referred for modification, the provisions of subsection (3) of this section shall be applicable.

          (2)  The legislature may adopt the proposed standards or refer the proposed standards to the commission for modification. If the legislature fails to adopt or refer the proposed standards to the commission by February 5th of the following year, the proposed standards shall take effect without legislative approval on July 1st of that year.

          (3) If the legislature refers the proposed standards to the commission for modification on or before February 5th, the commission shall resubmit the proposed modifications to the legislature no later than February 26th.  The legislature may adopt or modify the resubmitted proposed standards.  If the legislature fails to adopt or modify the resubmitted proposed standards by March 1st, the resubmitted proposed standards shall take effect without legislative approval on July 1st of that year.

 

          NEW SECTION.  Sec. 3.  The secretary shall cause the implementation of the standards  approved under section 1 of this act to be monitored and evaluated.  The monitoring standards guidelines proposed by the juvenile disposition standards commission in the proposed detention standards dated October 1987, shall be followed in conducting the monitoring and evaluation. The secretary shall provide for site visits not less than once a year.  The department shall compile the results and submit a report to the legislature by October 1st of each odd- numbered year.

 

          NEW SECTION.  Sec. 4.     The secretary shall cause the standards approved under section 1 of this act and as modified under section 2 of this act to be distributed to every county in the state of Washington and shall maintain a sufficient supply of copies of the standards for distribution to all interested persons.

 

          NEW SECTION.  Sec. 5.     Sections 1 through 4 of this act are each added to chapter 13.40 RCW.
