AN ACT Relating to the existence of city or town territory within a library district; amending RCW 27.12.360; adding a new section to chapter 27.12 RCW; adding a new section to chapter 70.44 RCW; adding a new section to chapter 84.09 RCW; and declaring an emergency.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  Section 1, chapter 353, Laws of 1977 ex. sess. as last amended by section 13, chapter 123, Laws of 1982 and RCW 27.12.360 are each amended to read as follows:

          Any city or town with a population of one hundred thousand or less at the time of annexation which does not have a public hospital district located within all or part of its boundaries may become a part of any rural county library district, island library district, or intercounty rural library district lying contiguous thereto by annexation in the following manner:  The inclusion of such a city or town may be initiated by the adoption of an ordinance by the legislative authority thereof stating its intent to join the library district and finding that the public interest will be served thereby.  Before adoption, the ordinance shall be submitted to the library board of the city or town for its review and recommendations.  If no library board exists in the city or town, the state librarian shall be notified of the proposed ordinance.  If the board of trustees of the library district concurs in the annexation, notification thereof shall be transmitted to the legislative authority or authorities of the counties in which the city or town is situated.

NEW SECTION. Sec. 2.  A new section is added to chapter 27.12 RCW to read as follows:

          The city or town portion of a library district that was annexed under RCW 27.12.360 through 27.12.395 is withdrawn, or deannexed, from the library district immediately upon the effective date of this section if a public hospital district is located within all or part of the city or town.  The library district shall continue to provide library service within the city or town throughout the remainder of 1988.

NEW SECTION. Sec. 3.  A new section is added to chapter 70.44 RCW to read as follows:

          The city or town portion of a library district that was annexed under RCW 27.12.360 through 27.12.395 shall not be included in an area incorporated as a public hospital district nor included in an area annexed by a public hospital district.

NEW SECTION. Sec. 4.  A new section is added to chapter 84.09 RCW to read as follows:

          Notwithstanding RCW 84.09.030, the boundaries established in 1988 for purposes of taxation by any library district from which territory was withdrawn under section 2 of this act, and the boundaries of the city or town which was removed from a library district under section 2 of this act, shall be established after the removal of such territory.

NEW SECTION. Sec. 5.     This act is necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.
