AN ACT Relating to public utility districts offering radio communication services; and adding a new section to chapter 54.16 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 54.16 RCW to read as follows:

          (1) A district may offer land, air, or marine mobile telecommunications or other radio telecommunications services.  The services may be offered to consumers within the service territory of the district, of another district, or of a county, town, or city.  If the services are offered to consumers outside the service territory of the district, permission must first be obtained from the governing body of the appropriate jurisdiction.

          (2) A district offering land, air, or mobile marine telecommunications or other radio communication services is not a radio communications service company under RCW 80.04.010 and is not subject to RCW 80.66.010.
