AN ACT Relating to higher education tuition and fees; and amending RCW 28B.15.015.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  Section 4, chapter 37, Laws of 1982 1st ex. sess. as amended by section 64, chapter 370, Laws of 1985 and RCW 28B.15.015 are each amended to read as follows:

          The higher education coordinating board, upon consideration of advice from representatives of the state's institutions with the advice of the attorney general, shall adopt rules and regulations to be used by the state's institutions for determining a student's resident and nonresident status and for recovery of fees for improper classification of residency:  PROVIDED, That if the head of a student's household has received a permanent job transfer to Washington state by his or her employer, the student shall be considered a resident of Washington for purposes of this section.
