AN ACT Relating to solid waste energy recovery or incineration facilities; and adding new sections to chapter 70.95 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.     After July 1, 1988, new permits shall not be issued for siting solid waste energy recovery or incineration facilities.

NEW SECTION. Sec. 2.     The department shall prepare a report by December 15, 2001, to the legislature addressing the following issues:

          (1) Procedures necessary to ensure that air emissions from solid waste energy recovery and incineration facilities pose no danger to human health or the environment;

          (2) Procedures necessary to ensure that ash residues from solid waste energy recovery or incineration facilities pose no danger to human health or the environment;

          (3) Procedures to implement state-wide waste reduction and recycling programs to ensure that the maximum possible quantities of solid waste are reduced or recycled; and

          (4) A recommended date for the repeal of section 1 of this act.  The recommendation shall be based on the conclusion that the procedures listed in subsections (1) through (3) of this section have been fully implemented.

NEW SECTION. Sec. 3.     Sections 1 and 2 of this act are each added to chapter 70.95 RCW.
