AN ACT Relating to environmental protection; and adding a new section to chapter 70.132 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 70.132 RCW to read as follows:

          No person may sell at retail or offer for sale at retail within this state any food or beverage in a type of container not used for that food or beverage prior to the effective date of this act unless the container has been approved by the department of ecology.

          The department of ecology shall approve containers for use in this state only if the container is biodegradable or the manufacturer establishes that an effective recycling program is in place to ensure recycling and the product is labeled with recycling instructions.
