AN ACT Relating to above-ground storage of oil or oil products; and adding a new section to chapter 90.48 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 90.48 RCW to read as follows:

          (1) After January 1, 1989, it shall be unlawful for any person to store oil or oil products in excess of six hundred sixty gallons above the surface of the ground where failure of the primary containment system could result in entry of oil into surface waters of the state, without the provision of a secondary containment system.

          (2) For purposes of this section, secondary containment means any appropriate containment or diversion structure which would prevent entry of spilled oil into surface waters of the state due to the failure of the primary containment system.
