AN ACT Relating to combining existing food and game fish and wildlife licenses; amending RCW 75.25.130; adding a new section to chapter 77.32 RCW; creating a new section; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 77.32 RCW to read as follows:

          (1) The licenses for Hood Canal shrimp under RCW 75.25.015 and personal use under RCW 75.25.090, and those licenses required under RCW 77.32.101, 77.32.161, and 77.32.191 shall all be offered and contained on one form.  Each individual license of the form shall be effective only upon payment of the appropriate fee and validation by the department.  The form shall be prepared in such a manner as to provide space for any necessary stamps and for identification of punchcard numbers as may be required.  The department shall also offer for sale the razor clam license required under RCW 75.25.020.

          (2) In addition to the license fee, dealers may charge a dealer's fee to be determined by the director for each Hood canal shrimp license, razor clam license, and personal use license.

          (3) The department of wildlife shall be solely responsible for the sale and accounting of the licenses identified in subsection (1) of this section.

          (4) License fees and punchcard fees collected by the department for the sale of licenses under subsection (1) of this section shall be remitted to the state treasurer for deposit into the appropriate account.

 

          NEW SECTION.  Sec. 2.     The department of fisheries and the department of wildlife shall jointly develop the rules necessary to implement the single license form document under section 1 of this act not later than August 1, 1988.

 

        Sec. 3.  Section 12, chapter 327, Laws of 1977 ex. sess. as last amended by section 6, chapter 87, Laws of 1987 and RCW 75.25.130 are each amended to read as follows:

          (1) All ((licenses,)) punchcards((,)) and stamps required by this chapter shall be issued only under authority of the director.  The director  may authorize ((license)) dealers to issue the ((licenses,)) punchcards((,)) and stamps and collect the ((license)) fees.  In addition to the ((license,))  punchcard((,)) or stamp fee, dealers may charge a dealer's fee of fifty cents for each ((Hood Canal shrimp license, two-consecutive-day combined license and punchcard, personal use license,)) punchcard((, and razor clam license)).  The dealer's fee may be retained by the ((license)) dealer.

          The director shall adopt rules for the issuance of ((personal use licenses, Hood Canal shrimp licenses, razor clam licenses,)) stamps((,)) and punchcards and for the collection, payment, and handling of ((license)) fees and dealers' fees.

          (2)  Hood Canal shrimp licenses, personal use licenses, and razor clam licenses required by this chapter shall be issued only by authority of the director of wildlife.  The director of wildlife may authorize license dealers to issue licenses and collect license fees.  In addition to the license fee, the dealer may charge a dealer's fee, to be determined by the director of wildlife, for each Hood Canal shrimp license, personal use license, and razor clam license.  The dealer's fee may be retained by the dealer.

 

          NEW SECTION.  Sec. 4.     By December 15, 1989, the departments of fisheries and wildlife shall present to the appropriate standing committees of the house of representatives and the senate a plan for consolidating the punchcards required for steelhead, salmon, and sturgeon into one punchcard.

 

          NEW SECTION.  Sec. 5.     Section 1 of this act shall take effect January 1, 1989.
