AN ACT Relating to transfer of pregnant employees; and adding a new section to chapter 49.60 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 49.60 RCW to read as follows:

          (1) It shall be an unfair practice for an employer, who has a policy, practice, or collective bargaining agreement requiring or authorizing the transfer of temporarily disabled employees to less strenuous or hazardous positions for the duration of the disability, to refuse to transfer a pregnant employee who so requests.

          (2) It shall be an unfair practice for any employer to refuse to temporarily transfer a pregnant employee to a less strenuous or hazardous position for the duration of her pregnancy if she so requests, upon the advice of her physician, and the transfer can be reasonably accommodated.

          (3) This section shall not be construed to affect any other provision of law relating to sex discrimination or pregnancy.
