AN ACT Relating to burglary in the second degree; amending RCW 9A.52.030; and reenacting and amending RCW 9.94A.320.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

Sec. 1. Section 9A.52.030, chapter 260, Laws of 1975 1st ex. sess. as amended by section 7, chapter 38, Laws of 1975-'76 2nd ex. sess. and RCW 9A.52.030 are each amended to read as follows:

(1) A person is guilty of burglary in the second degree if, with intent to commit a crime against a person or property therein, he or she:

(a) Enters or remains unlawfully in a building that is not a dwelling and is other than a vehicle.

(b) Enters or remains unlawfully in a building that is a dwelling, other than a vehicle.

(2) Burglary in the second degree is a class B felony.

Sec. 2. Section 3, chapter 115, Laws of 1983 as last amended by section 4, chapter 187, Laws of 1987 and by section 1, chapter 224, Laws of 1987 and RCW 9.94A.320 are each reenacted and amended to read as follows:
