AN ACT Relating to parental consent; adding new sections to chapter 74.09 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     This act is necessary for the immediate preservation of the public peace, health, morals, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.

 

          NEW SECTION.  Sec. 2.     No state or local government, or any political subdivision or agency thereof, and no nongovernmental agency, organization, or facility receiving public moneys, either directly or indirectly, may distribute or otherwise provide access to, either directly or by referral, any contraceptive instrument, article, or device to any unemancipated minor without the prior written consent of the minor's parent or guardian.

 

          NEW SECTION.  Sec. 3.     No state or local government, or any political subdivision or agency thereof, and no nongovernmental agency, organization, or facility receiving public moneys, either directly or indirectly, may administer or otherwise provide access to, either directly or by referral, any abortion procedure to any unemancipated minor without the prior written consent of the minor's parent or guardian, except to prevent the death of either the pregnant mother or her unborn child under circumstances where every reasonable effort is made to preserve the life of each.

 

          NEW SECTION.  Sec. 4.     Sections 2 and 3 of this act are each added to chapter 74.09 RCW.
