AN ACT Relating to surrogate parenting; adding new sections to chapter 26.26 RCW; prescribing penalties; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 26.26 RCW to read as follows:

          This act is necessary for the immediate preservation of the public peace, health, morals, and safety, the support of the state government and its existing public institutions, and shall take effect immediately.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 26.26 RCW to read as follows:

          (1) No person or organization of persons shall enter into any agreement or contract, written or unwritten, with or without valuable consideration, whereby a person not married to the contributor of sperm agrees to be inseminated, to carry the resulting child to birth, and then to relinquish to the contributor of the sperm the custody of and all rights and obligations to the child.

          Such an agreement or contract, whether executed in Washington or any other jurisdiction, shall be absolutely null and shall be void and unenforceable as contrary to public policy.

          (2) Any person violating any provision of this act shall be guilty of a gross misdemeanor.
