AN ACT Relating to prohibiting the sale or use of tributyltin in paints; and adding a new section to chapter 70.54 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.54 RCW to read as follows:

          (1) The use of solvent based tributyltin in paints, the sale of solvent based tributyltin for use in paints, and the sale of paints containing solvent based tributyltin is prohibited as of January 1, 1988.

          (2) When the United States environmental protection agency develops standards for the use of polymer bound tributyltin in paints, the state shall immediately implement those standards.  In the event that preliminary standards are not promulgated by the United States environmental protection agency prior to January 1, 1988, the department of agriculture shall establish the same limiting concentration for polymer bound tributyltin as is currently imposed in England.

          (3) The department of agriculture shall be responsible for enforcing this section.  The department of agriculture shall adopt rules to carry out this section.
