AN ACT Relating to motor vehicle emission inspections; and adding new sections to chapter 70.120 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     The legislature finds and declares that:  (1) After five years of mandatory motor vehicle inspections, King county is in substantial compliance with the federal air quality standards; (2) the improvements in air quality are primarily due to federal manufacturing standards for automobiles and not to motor vehicle inspections; and (3) the motor vehicle inspection program in King county is no longer necessary.

 

          NEW SECTION.  Sec. 2.     (1) Within ten days of the effective date of this section, the department shall petition the United States environmental protection agency to declare King county in substantial compliance with federal air quality standards and to eliminate the requirement for motor vehicle emission inspections.

          (2) If, within sixty days of sending the petition, the department does not receive formal notification by the United States environmental protection agency that King county will not be declared in substantial compliance with federal air quality standards and that the requirement for motor vehicle emission inspections will not be eliminated, the mandatory motor vehicle inspection program in King county shall be terminated.

 

          NEW SECTION.  Sec. 3.     Sections 1 and 2 of this act are each added to chapter 70.120 RCW.
