AN ACT Relating to solid waste landfills; and adding a new section to chapter 70.95 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.95 RCW to read as follows:

          In order to comply with the solid waste management priorities established in RCW 70.95.010, the legislature finds that the following provisions are necessary:

          (1) Beginning January 1, 1992, disposal of solid waste in landfills is prohibited in class AA and A counties, except for: (a)  Ash residue from energy recovery or incineration, and (b) materials that are technically unsuitable for incineration.

          (2) Permits shall not be issued for new solid waste landfills in class AA or A counties unless it can be demonstrated that a new landfill is necessary for the disposal of ash residue from incineration or materials that are unsuitable for incineration.

          (3) The department shall adopt, by rule:  (a) A list of materials that are technically unsuitable for incineration, and (b) criteria to determine whether or not a new solid waste landfill is necessary pursuant to subsection (2) of this section.
