AN ACT Relating to the budget; making appropriations and authorizing expenditures for the operations of state agencies for the fiscal biennium beginning July 1, 1987, and ending June 30, 1989; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.     (1) A budget is hereby adopted and, subject to the provisions set forth in the following sections, the several amounts specified in the following sections, or so much thereof as shall be sufficient to accomplish the purposes designated, are hereby appropriated and authorized to be incurred for salaries, wages, and other expenses of the agencies and offices of the state and for other specified purposes for the fiscal  biennium beginning July 1, 1987, and ending June 30, 1989, except as otherwise provided, out of the several funds of the state hereinafter named.

          (2) Unless the context clearly requires otherwise, the definitions in this section apply throughout this act.

          (a) "Fiscal year 1988" or "FY 1988" means the fiscal year ending June 30, 1988.

          (b) "Fiscal year 1989" or "FY 1989" means the fiscal year ending June 30, 1989.

          (c) "Provided solely" means the specified amount may be spent only for the specified purpose.  Unless otherwise specifically authorized in this act, any portion of an amount provided solely for a specified purpose which is unnecessary to fulfill the specified purpose shall revert.

          (d) "Revert" or "lapse" means the amount shall return to an unappropriated status.

 

 

          NEW SECTION.  Sec. 2.     If House Bill No. ...., the governor's comprehensive revenue act, fails to be enacted, each of the appropriations for agencies affected by the governor's education proposal shall revert to the levels specified in the governor's Current Law Budget proposal and the basic education formula, including the handicapped formula, shall revert to the prior year formula as provided in RCW 28A.41.140, including 1985-87 procedures governing K-12 certificated and classified salary compliance.

          The appropriations in this section are subject to the following conditions and limitations:

          (1) $1,020,755 of the general fund appropriation is provided solely to reimburse counties for the state's share of primary and general election costs and the costs of conducting mandatory recounts on state measures.

          (2) $1,662,254 of the general fund appropriation is provided solely for the verification of initiative and referendum petitions and the maintenance of related voter registration records, legal advertising of state measures, and the publication and distribution of the voters and candidates pamphlet.

          (3) $59,691 of the archives and records management account appropriation is provided solely for a project that will evaluate the need for, and potential archival requirements of, storage of data contained in magnetic media (tapes and disks).  Implementation of an archival program for magnetic media shall not begin prior to approval of the findings and recommendations of the project by the office of financial management.

          NEW SECTION.  Sec. 503.  !tp2,1,1FOR THE SUPERINTENDENT OF PUBLIC INSTRUCTION‑-FOR GENERAL APPORTIONMENT (BASIC EDUCATION)

          The appropriation in this section is subject to the following conditions and limitations:

          (1) $367,646,000 is provided solely for the remaining months of the 1986-87 school year.

          (2) Allocations for certificated instructional staff salaries for the 1987-88 and 1988-89 school years shall be determined by multiplying each district's average basic education certificated instructional salary calculated using the state-wide minimum salary index described in HB .... or SB .... (Z-732).  For the purposes of this section, the beginning base salary level for a certificated instructional staff person with zero years of experience, a baccalaureate degree, and a salary index factor of one shall be $16,800.  Such salary is then multiplied by the districts' formula-generated certificated instructional staff units as follows:

          (a) Forty-six certificated instructional staff units for each average annual one thousand full time equivalent kindergarten through twelfth grade students, excluding handicapped full time equivalent enrollment as calculated under section 505 of this act and excluding full time equivalent enrollment otherwise recognized for certificated staff unit allocations in subsection (2) (e) through (g) of this section.

          (b) Five certificated instructional staff units for each average annual one thousand full time equivalent kindergarten through third grade students, excluding handicapped full time equivalent enrollment as calculated under section 505 of this act, and excluding full time equivalent enrollment otherwise recognized for certificated staff unit allocations in subsections (e) through (g) of this section.  $61,324,000 of the appropriation provided in this section shall be used solely to increase the certificated instructional staff allocation from forty-seven to fifty-one certificated instructional staff units per one thousand full time equivalent kindergarten through third grade students beginning with the 1987-88 school year.  These funds shall be considered levy reduction funds as defined in HB .... or SB .... (Z-732).  For all districts for which these funds are not designated as levy reduction funds, these funds are intended solely to increase instructional staff in grades kindergarten through third grade.

          (c) School districts with a minimum enrollment of 250 full time equivalent students and whose full time equivalent student enrollment count in a given month exceeds the first of the month full time equivalent enrollment count by 5 percent are entitled to an additional state allocation of 110 percent of the pro rata share that such district would have generated had such additional full time equivalent students been included in the normal enrollment count for that particular month.

          (d) 57.14 certificated instructional staff units for each average annual one thousand full time equivalent students enrolled in a vocational education program approved by the superintendent of public instruction.  However, in skill centers, the ratio shall be sixty certificated instructional staff units for each annual average one thousand full time equivalent students enrolled in an approved vocational education program.

          (e) For districts enrolling not more than twenty-five average annual full time equivalent students and for small school plants within any school district, which small plants enroll not more than twenty-five average annual full time equivalent students and have been judged to be remote and necessary by the state board of education, certificated staff units shall be determined as follows:

          (i) For those enrolling no students in grades seven or eight, two certificated staff units for enrollment of not more than five students, plus one-twentieth of a certificated staff unit for each additional student enrolled; and

          (ii) For those enrolling students in either grades seven or eight, two certificated staff units for enrollment of not more than five students, plus one-tenth of a certificated staff unit for each additional student enrolled.

          (f) For districts enrolling more than twenty-five but not more than one hundred average annual full time equivalent students (except as otherwise specified) and for small school plants within any school district, which small plants enroll more than twenty-five average annual full time equivalent students and have been judged to be remote and necessary by the state board of education, certificated staff units shall be determined as follows:

          (i) For grades K-6, for enrollments of not more than sixty annual average full time equivalent students, three certificated staff units;

          (ii) For grades K-6, for enrollments above sixty annual average full time equivalent students, additional certificated staff units based upon a ratio of one certificated staff unit per twenty annual average full time equivalent students;

          (iii) For grades 7 and 8, for enrollments of not more than twenty annual average full time equivalent students, one certificated staff unit;

          (iv) For grades 7 and 8, for enrollments above twenty annual average full time equivalent students, additional certificated staff units based upon a ratio of one certificated staff unit per twenty annual average full time equivalent students;

          (v) For each nonhigh school district having an enrollment of more than seventy annual average full time equivalent students and less than one hundred eighty students, operating a grades K-8 program or a grades 1-8 program, an additional one-half of a certificated staff unit;

          (vi) For each nonhigh school district having an enrollment of more than fifty annual average full time equivalent students and less than one hundred eighty students, operating a grades K-6 program or a grades 1-6 program, an additional one-half of a certificated staff unit.

          (g) A district that operates no more than two high schools with enrollments of not more than three hundred average annual full time equivalent students shall be allocated  certificated staff units for enrollment in each such high school as follows:

          (i) Nine and one-half certificated staff units for the first sixty annual average full time equivalent students;

          (ii) Additional certificated staff units based upon a ratio of one certificated staff unit per forty-three and one-half average annual full time equivalent students.

          (h) Of the total certificated staff units generated for a district under (e), (f), and (g) of this subsection, four certificated staff units for each average annual one thousand full time equivalent kindergarten through twelfth grade students, excluding handicapped full time equivalent enrollment under section 505 of this act, shall be considered certificated administrative staff units and shall be allocated in the manner provided by subsection (3) of this section.

          (3) Allocations for certificated administrative staff salaries for the 1987-88 and 1988-89 school years shall be calculated by multiplying (a) each district's average basic education certificated administrative maintenance salary under section 504(2)(c) of this act by (b) four certificated administrative staff for each average annual one thousand full time equivalent kindergarten through twelfth grade students, excluding handicapped full time equivalent enrollment as calculated under section 505 of this act.

          (4) Allocations for classified salaries for the 1987-88 and 1988-89 school years shall be calculated by multiplying each district's average basic education classified maintenance salary under section 504(2)(d) of this act by the district's formula-generated classified staff units determined as follows:

          (a) Sixteen and sixty seven one hundredths classified staff units for each average annual one thousand full time equivalent kindergarten through twelfth grade students, or one classified staff unit for each sixty full time equivalent students.

          (b) One classified staff unit per each three certificated staff unit determined under subsection (2) (e), (f) (i) through (iv), and (g) of this section.

          (c) For each nonhigh school district with an enrollment of more than fifty annual average full time equivalent students and less than one hundred eighty students, an additional one-half of a classified staff unit.

          (5) Fringe benefit allocations shall be calculated at a rate of 19.41 percent in the 1987-88 school year and 19.53 percent in the 1987-88 school year of certificated salary allocations provided pursuant to subsection (3) of this section, and a rate of 17.00 percent in the 1987-88 school year and 17.12 percent in the 1988-89 school year of classified salary allocations provided pursuant to subsection (4) of this section.

          (6) Insurance benefit allocations for the 1987-88 and 1988-89 school years shall be calculated at a rate of $167 per month for the number of certificated staff units determined in subsection (3) of this section and for the number of classified staff units determined in subsection (4) of this section multiplied by 1.152.

          (7)(a) For nonemployee related costs with each certificated staff unit determined under subsections (2) (a), (e), (f), (g), and (3) of this section, there shall be provided a maximum of $6,049 per staff unit in the 1987-88 school year and a maximum of $6,267 per staff unit in the 1988-89 school year.

          (b) For nonemployee related costs with each certificated staff unit determined under subsection (2)(d) of this section, there shall be provided a maximum of $11,526 per staff unit in the 1987-88 school year and a maximum of $11,941 per staff unit in the 1988-89 school year.

          (8) Allocations for costs of substitutes for classroom teachers shall be provided at a rate of $278 per full time equivalent basic education classroom teacher during the 1987-88 and 1988-89 school years.

          (9) The superintendent shall distribute a maximum of $3,181,000 outside the basic education formula during fiscal years 1988 and 1989 as follows:

          (a) For fire protection for school districts located in a fire protection district as now or hereafter established pursuant to chapter 52.04 RCW, a maximum of $342,000 may be expended in fiscal year 1988 and a maximum of $342,000 in fiscal year 1989.

          (b) For summer vocational programs at skills centers, not more than $1,099,000 shall be expended in fiscal year 1988 and not more than $1,126,000 in fiscal year 1989.

          (c) For school district emergencies, a maximum of $136,000 may be expended in fiscal year 1988 and a maximum of $136,000 may be expended in fiscal year 1989.

          (10) For remote and necessary school plants on islands without scheduled transportation which are sole school plants serving students in elementary grades on these islands, not more than $156,000 may be expended in fiscal year 1988 and not more than $156,000 may be expended in fiscal year 1989 to enhance funding provided in subsections (2) through (9) of this section.

 

 

          NEW SECTION.  Sec. 504.  !tp2,1,1FOR THE SUPERINTENDENT OF PUBLIC INSTRUCTION‑-SCHOOL DISTRICT EMPLOYEE COMPENSATION

          (1) For the purposes of section 503 of this act and this section, the following conditions and limitations apply:

          (a) "Executive Document 1" means the state-wide salary schedule developed by the office of financial management, pursuant to HB .... or SB .... (Z-732).

          (b) "Executive Document 2" means the computer tabulation of 1985-86 school year salary data which identifies the additional maximum percentage allocations by district, by school year, which the superintendent of public instruction shall allocate to implement section 204(2) of HB .... or SB .... (Z-732).

          (c) "Executive Document 3" means the computer tabulation of salary data for allocation by the superintendent of public instruction on a district-by-district basis for the purposes enumerated in subsection (2) (c) of this section.

          (d) The appropriate salary index factor for each certificated instructional staff shall be determined by the school district solely on the basis of years of service and education experience as calculated using the state-wide salary index table, certified by the district as accurate and correct, and reported to the superintendent of public instruction for the purpose of calculating certificated instructional staff salary allocations.  Any change in the status of an individual previously certified, on the basis of additional years of service or education, shall be certified and reported to the superintendent of public instruction at the time such change takes place.

          (e) "Incremental fringe benefits" means 18.71 percent in school year 1987-88 and 18.97 percent in school year 1988-89 for certificated employees, and 13.41 percent in school year 1987-88 and 13.59 percent for school year 1988-89 for classified staff, which percentages shall be the fringe benefit rates applied to all salary adjustments provided in this section, and is for employer contributions to employee benefits and retirement benefits.

          (f) $5,195,000 of this appropriation is provided to increase the average monthly rate of insurance per full time equivalent certificated employee or classified unit to $170.90, beginning with the 1987-88 school year.  Classified units shall be calculated on the basis of 1,440 hours of work per year, with no individual employee counted for more than one unit.

          (2) For the purposes of this act, the following conditions and limitations apply:

          (a) Effective September 1, 1987, certificated instructional staff shall be paid in accordance with the state-wide minimum salary index described in HB .... or SB .... (Z-732).  The beginning base salary level for a certificated instructional staff person with zero years of experience, a baccalaureate degree, and a salary index factor of one shall be $18,000 per annum based on a one hundred eighty-five day contract.

          (b) Effective September 1, 1988, certificated instructional staff shall be paid in accordance with the state-wide minimum salary index contained in HB .... or SB .... (Z-732).  The beginning base salary level for a certificated instructional staff person with zero years of experience, a baccalaureate degree, and a salary index factor of one shall be $18,540 per annum based on a one hundred eighty-five day contract.

          (c) Allocations for certificated administrative staff salaries and classified staff salaries shall be based on Executive Document 3.

          (d) The legislature has determined that the allocation of compensation for certificated instructional staff calculated using the beginning base salaries established in (a) and (b) of this subsection applied to the state-wide salary index established in HB .... or SB .... (Z-732), improved by the fringe benefits established in sections ... and ... of this act, is sufficient to employ qualified teachers and meets all requirements of the Basic Education Act.  Compensation in excess of the salary and benefit allocations established in this act shall be subject to the provisions of HB .... or SB .... (Z-732) and shall not be considered a current or future obligation of the state.

          (e) "Certificated instructional staff" and "certificated administrative staff" have the meaning provided by HB .... or SB .... (Z-732).

          (3)(a) $88,733,000 is provided, effective September 1, 1987, to implement subsection (2) (a) and (c) of this section, including incremental fringe benefits.

          (b) $140,445,000 is provided, effective September 1, 1988, to implement subsection (2) (b) and (c) of this section, including incremental fringe benefits.

          (c) A maximum of $3,335,000 is provided for salary increases and incremental fringe benefits to implement the state-wide minimum salary index for certificated instructional staff under subsection (2)(a) of this section and certificated administrative and classified staff under subsection (2)(c) of this section, in the following programs, effective September 1, 1987, for the 1987-88 school year, to be distributed by increasing rates by the amount specified:

          (i) Transitional bilingual instruction (section 507), $28.62 per pupil;

          (ii) Remediation assistance (section 508), $8.97 per pupil;

          (iii) Education of highly capable students (section 509), $16.90 per pupil;

          (iv) Vocational technical institutes (section 511), $131.30 per FTE pupil; and

          (v) Pupil transportation (section 513), $0.50 per weighted pupil mile;

          (d) A maximum of $7,679,000 is provided for salary increases and incremental fringe benefits to implement the state-wide minimum salary schedule for certificated instructional staff referenced in subsection (2)(a) of this section, for certificated administrative staff referenced in subsection (2)(c) of this section, and for classified staff as referenced in subsection (2)(d) of this section in the following programs, effective September 1, 1988, for the 1988-89 school year, to be distributed by increasing rates by the amount specified:

          (i) Transitional bilingual instruction (section 507), $41.31 per pupil;

          (ii) Remediation assistance (section 508), $18.17 per pupil;

          (iii) Education of highly capable students (section 509), $24.42 per pupil;

          (iv) Vocational technical institutes (section 511), $196.79 per FTE pupil; and

          (v) Pupil transportation (section 513), $0.99 per weighted pupil mile.

          (e) A maximum of $36,895,000 is provided for salary increases and incremental fringe benefits for state-supported staff unit allocations in the handicapped program, section 505, and for state-supported staff in educational service districts, section 502, and institutional education programs, section 506.  The superintendent of public instruction shall distribute funds to for these programs in accordance with this section.

          (4) Compensation granted in this section shall be included in the programs referenced in RCW 84.52.0531(1) for the purposes of calculating the levy lid.

          (1) Not more than $11,159,490 of the general fund‑-state appropriation shall be expended for the 1987-88 school year, distributed as follows:

          (a) A maximum of $4,129,728 is provided for programs in state institutions for the handicapped or emotionally disturbed distributed at a maximum average rate of $10,299 per full time equivalent student.

          (b) A maximum of $2,972,287 is provided for programs in state institutions for delinquent youth distributed at a maximum average rate of $5,394 per full time equivalent student.

          (c) A maximum of $321,415 is provided for programs in state group homes for delinquent youth distributed at a maximum average rate of $3,032 per full time equivalent student.

          (d) A maximum of $1,968,852 is provided for juvenile parole learning center programs distributed at a maximum average rate of $4,051 per full time equivalent student, excluding funds provided through the basic education formula established in section 503 of this act.

          (e) A maximum of $1,767,208 is provided for programs in county detention centers distributed at a maximum average rate of $4,016 per full time equivalent student.

          (2) Not more than $10,781,760 of the general fund‑-state appropriation shall be expended for the 1988-89 school year, distributed as follows:

          (a) A maximum of $3,735,299 is provided for programs in state institutions for the handicapped or emotionally disturbed distributed at a maximum average rate of $10,290 per full time equivalent student.

          (b) A maximum of $2,888,419 is provided for programs in state institutions for delinquent youth distributed at a maximum average rate of $5,399 per full time equivalent student.

          (c) A maximum of $322,417 is provided for programs in state group homes for delinquent youth distributed at a maximum average rate of $3,042 per full time equivalent student.

          (d) A maximum of $2,064,033 is provided for juvenile parole learning center programs distributed at a maximum average rate of $4,055 per full time equivalent student, excluding funds provided through the basic education formula established in section 503 of this act.

          (e) A maximum of $1,771,592 is provided for programs in county detention centers distributed at a maximum average rate of $4,026 per full time equivalent student.

          (2) Funding for school district remediation programs serving grades two through nine shall be distributed during the 1987-88 and 1988-89 school years at a maximum rate of $347 per unit as calculated pursuant to this subsection.  The number of units for each school district shall be the sum of:  (a) The number of students enrolled in grades two through six in the district multiplied by the percentage of students taking the fourth grade basic skills test  who scored in the lowest  quartile as compared to national norms, and then reduced to the extent that the number of students ages seven through eleven in the district who are identified as specific learning disabled and served through programs established pursuant to chapter 28A.13 RCW exceeds four percent of the district full time equivalent enrollment in grades two through six; and (b) the number of students enrolled in grades seven through nine in the district multiplied by the percentage of students taking the eighth grade basic skills test who scored in the lowest quartile as compared to national norms, and then reduced to the extent that the number of students ages twelve through fourteen in the district who are identified as specific learning disabled and served through programs established pursuant to chapter 28A.13 RCW exceeds four percent of the district full time equivalent enrollment in grades seven through nine.  For the purposes of allocating funds for the 1987-88 school year, the superintendent shall use the  most recent prior five-year average scores on the fourth grade test and the most recent prior three-year average scores on the eight grade test.  For the purposes of allocating funds for the 1988-89 school year, the superintendent shall use the most recent prior five-year average scores on the fourth grade test and the most recent prior four-year average scores on the eighth grade test.

          The appropriations in this section, or so much thereof as may be necessary, shall be expended exclusively for the purposes designated in this section and are subject to the conditions and limitations specified in this section.

          (1) $55,577,080 of the general fund‑-state appropriation, $12,876,990 of the general fund‑-federal appropriation, and $34,024,672 of the special fund salary and insurance contribution increase revolving fund appropriation are provided for a three percent salary increase effective September 1, 1987, and an additional three percent salary increase effective September 1, 1988, for state personnel board classified and exempt employees, higher education personnel board classified employees, and higher education exempt employees employed by the higher education coordinating board and the higher education personnel board.  These increases shall be implemented in compliance and conformity with all requirements of the comparable worth agreement ratified by 1986 Senate Concurrent Resolution No. 126.

          (2) $164,418 of the general fund‑-state appropriation and $2,746,837 of the special fund salary and insurance contribution increase revolving fund appropriation are provided for a three percent salary increase effective September 1, 1987, followed by an additional three percent salary increase effective September 1, 1988, for commissioned officers of the Washington state patrol.

          (3) The governor shall allocate to state agencies from the general fund‑-state appropriation $5,000,000 for fiscal year 1988 and $10,000,000 for fiscal year 1989, and from the special fund salary and insurance contribution increase revolving fund appropriation $3,100,000 for fiscal year 1988 and $6,200,000 for fiscal year 1989 to fulfill the 1987-89 obligations of the comparable worth agreement ratified by 1986 Senate Concurrent Resolution No. 126.

          (4)(a) $3,239,056 of the general fund‑-state appropriation, $567,923 of the general fund‑-federal appropriation, and $1,400,565 of the special fund salary and insurance contribution increase revolving fund appropriation are provided for increasing the state contribution to the state employees insurance board to $170.90 per eligible employee, per month.

          (b) The monthly contributions for insurance benefits shall not exceed $170.90 per eligible employee.

          (c) Any returns of funds to the state employees' insurance board resulting from favorable claims experienced during the 1987-89 biennium shall be held in reserve within the state employees insurance fund until appropriated by the legislature.

          (d) Funds provided under this section, including funds resulting from dividends or refunds, shall not be used to increase employee insurance benefits over the level of services provided on the effective date of this act.  Contributions by any county, municipal, or other political subdivision to which coverage is extended after the effective date of this act shall not receive the benefit of any surplus funds attributable to premiums paid prior to the date on which coverage is extended.

          (5) To facilitate the transfer of moneys from dedicated funds and accounts, the state treasurer is directed to transfer sufficient moneys from each dedicated fund or account to the special fund salary and insurance contribution increase revolving fund in accordance with schedules provided by the office of financial management.

          (6) In calculating individual agency allocations for this section, the office of financial management shall calculate the allocation of each subsection separately.  The separate allocations for each agency may be combined under a single appropriation code for improved efficiency.  The office of financial management shall transmit a list of agency allocations by subsection to the committees on ways and means of the senate and house of representatives.

          (5) The employer rate for all employers of members of the retirement system governed by chapter 41.40 RCW (the public employees' retirement system) shall be set at 6.08% of pay for the 1987-89 biennium.  This rate consists of 5.76% to fund the value of benefits earned during the 1987-89 biennium; 0.11% to fund the costs of the cost-of-living adjustment under chapter 306, Laws of 1986; 0.05% to fund the costs of the restoration of member service credit (open window) under chapter 317, Laws of 1986; and 0.16% for the administrative expense rate for the department of retirement systems.

          (6) The employer rate for all employers of members of the retirement system governed by chapter 43.43 RCW (the state patrol retirement system) shall be set at 19.88%, the level recommended by the state actuary.

          (1) The appropriations in this section are provided solely for the increased demands for public services as a result of the development or construction of the Everett Homeport.  No funds may be spent until actual construction or site preparation is started except as may be necessary to meet the requirements of federal legislation authorizing the construction of the Everett Homeport.

          NEW SECTION.  Sec. 719.              The appropriations contained in this act are maximum expenditure authorizations.  Pursuant to RCW 43.88.037, moneys disbursed from the treasury on the basis of a formalized loan agreement with another governmental entity shall be treated as a loan and are to be recorded as loans receivable and not as expenditures for accounting purposes.  To the extent that moneys are disbursed on a loan basis, the corresponding appropriation shall be reduced by the amount of loan moneys disbursed from the treasury during the 1987-89 biennium.

 

 

          NEW SECTION.  Sec. 720.              Notwithstanding the provisions of chapter 82, Laws of 1973 1st ex. sess., the house of representatives, the senate, and the permanent statutory committees shall pay expenses quarterly to the department of general administration facilities and services revolving fund for services rendered by the department for operations, maintenance, and supplies relating to buildings, structures, and facilities utilized by the legislature for the biennium beginning July 1, 1987.

 

 

          NEW SECTION.  Sec. 721.              Whenever allocations are made from the governor's emergency fund appropriation to an agency which is financed in whole or in part by other than general fund moneys, the director of financial management may direct the repayment of such allocated amount to the general fund from any balance in the fund or funds which finance the agency.  No appropriation shall be necessary to effect such repayment.

 

 

          NEW SECTION.  Sec. 722.              In addition to the amounts appropriated in this act for revenue for distribution, bond retirement and interest including ongoing bond registration and transfer charges, transfers, interest on registered warrants, and certificates of indebtedness, there is also appropriated such further amounts as may be required or available for these purposes under any statutory formula or under any proper bond covenant made in accordance with law.

 

          NEW SECTION.  Sec. 723.              In addition to such other appropriations as are made by this act, there is hereby appropriated to the state finance committee from legally available bond proceeds in the respective construction or building funds and accounts such amounts as are necessary to pay the expenses incurred in the issuance and sale of the subject bonds.

 

          NEW SECTION.  Sec. 724.              Amounts received by an agency as reimbursements pursuant to RCW 39.34.130 shall be considered as returned loans of materials supplied or services rendered.  Such amounts may be expended as a part of the original appropriation of the fund to which it belongs, without further or additional appropriation, subject to conditions and procedures prescribed by the director of financial management, which shall provide for determination of full costs, disclosure of such reimbursements in the governor's budget, maximum interagency usage of data processing equipment and services, and such restrictions as will promote more economical operations of state government without incurring continuing costs beyond those reimbursed.

 

          NEW SECTION.  Sec. 725.              The appropriations of moneys and the designation of funds and accounts by this and other acts of the 1987 legislature shall be construed in a manner consistent with legislation enacted by the 1985 and 1987 legislatures to conform state funds and accounts with generally accepted accounting principles.

 

          NEW SECTION.  Sec. 726.              If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.

 

          NEW SECTION.  Sec. 727.              This act is necessary for the immediate preservation of the public peace, health, and safety, the support of the state government and its existing public institutions, and shall take effect July 1, 1987.
