AN ACT Relating to unemployment insurance coverage for service performed in agricultural employment; adding a new section to chapter 50.04 RCW; creating new sections; repealing RCW 50.04.150 and 50.04.155; and providing an effective date.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  The following acts or parts of acts are each repealed:

                   (1) Section 16, chapter 35, Laws of 1945, section 3, chapter 215, Laws of 1947, section 1, chapter 264, Laws of 1957, section 2, chapter 292, Laws of 1977 ex. sess. and RCW 50.04.150; and

          (2) Section 3, chapter 292, Laws of 1977 ex. sess. and RCW 50.04.155.

NEW SECTION. Sec. 2.     This act shall not be construed as affecting any existing right acquired or liability or obligation incurred under the sections repealed in this act, or under any rule, regulation, or order adopted under those sections, nor as affecting any proceeding instituted thereunder.

NEW SECTION. Sec. 3.  A new section is added to chapter 50.04 RCW to read as follows:

          Effective with benefit years beginning on and after January 4, 1988, base year wages shall include remuneration paid for previously uncovered services.  For the purpose of this section, the term "previously uncovered services" means services performed at any time during the one-year period ending December 31, 1987, which are excluded from employment as defined in Title 50 RCW by the sections repealed in section 1, chapter ..., Laws of 1987 (section 1 of this act).

NEW SECTION. Sec. 4.     The repeal of RCW 50.04.150 by section 1 of this act is not intended to affect the incorporation by reference of RCW 50.04.150 by RCW 49.12.185.

NEW SECTION. Sec. 5.     This act shall take effect January 1, 1988.
