AN ACT Relating to the allowance of costs in actions to foreclose on timber and lumber liens; amending RCW 60.24.180; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  Section 17, chapter 132, Laws of 1893 as amended by section 1, chapter 23, Laws of 1901 and RCW 60.24.180 are each amended to read as follows:

          Any number of persons claiming liens under this chapter may join in the affidavit in RCW 60.24.075 provided, and may join in the same action, and when separate actions are commenced the court may consolidate them.  The court ((shall also allow as part of the costs the moneys paid for filing, making and recording the claim, and a reasonable attorney's fee for each person claiming a lien)) may allow, in any action to foreclose a lien established under this chapter, to the prevailing party in the action, as part of the cost of the action, the amount paid for filing or recording the claim, and a reasonable attorney's fee in the superior court, the court of appeals, and the supreme court.

 

          NEW SECTION.  Sec. 2.     Section 1 of this act applies to any action which has not been finally disposed of by a court of competent jurisdiction by the effective date of this section.
