AN ACT Relating to pharmacies; and adding a new section to chapter 18.64 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 18.64 RCW to read as follows:

          (1) It is unlawful to dispense a legend drug unless the drug is (a) accepted in person at the dispensing pharmacy by the patient, or (b) delivered to the patient by an employee of the dispensing pharmacy.

          (2) It is unlawful to dispense legend drugs to any person within this state if the dispensing pharmacy is located outside the state.

NEW SECTION. Sec. 2.     If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.
