AN ACT Relating to county roads; and amending RCW 36.33.220.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

        Sec. 1.  Section 1, chapter 25, Laws of 1971 ex. sess. as last amended by section 142, chapter 195, Laws of 1973 1st ex. sess. and RCW 36.33.220 are each amended to read as follows:

(1) The legislative authority of any county may budget, in accordance with the provisions of chapter 36.40 RCW, and expend ((any portion)) no more than ten percent of the county road property tax revenues for any service to be provided in the unincorporated area of the county notwithstanding any other provision of law, including chapter 36.82 RCW and RCW 84.52.050 and RCW 84.52.043.  The limit on expenditure of county road revenues under this section does not apply to counties of the seventh class.

(2) Funds may be diverted under subsection (1) of this section only by those counties diverting such funds as of the effective date of this 1987 section.
