BACKGROUND:

 

Many governmental units enter into interlocal agreements to provide public services jointly.  All interlocal agreements must be filed with the appropriate city clerk and county auditor, and with the Secretary of State.

 

Each year, approximately 200 interlocal agreements are filed with the office of the Secretary of State.  Upon receipt, these agreements are filed in the state archives.  It has been suggested that the filing requirement be removed, since so few requests are made to the office to review these agreements.

 

SUMMARY:

 

The authority which requires interlocal agreements to be filed with the office of the Secretary of State is eliminated.
