BACKGROUND:
The Local Transportation Act of 1988 authorizes local governments (cities, counties and transportation benefit districts) to develop and adopt a program for joint funding, from both public and private sources, of transportation improvements necessitated by economic development and growth. The programs, to be adopted by ordinance, are required to: identify areas affected by the off-site transportation improvements; identify specific improvements based on a long term transportation plan; and develop a six-year capital program to accomplish those improvements. Local governments are authorized to impose a fee on developers to pay for the impact of off-site transportation improvements.
SUMMARY:
Language is clarified in the Local Transportation Act of 1988 regarding credits for developers constructing off-site transportation facilities. These facilities are more clearly identified as transportation improvements, making that term consistent with definitions set forth in the chapter and terminology used in the section.
