BACKGROUND:
Penalties collected by local air pollution control authorities from violators of the Washington Clean Air Act are paid into the treasury of the authority and credited to its funds. Air authorities are required to remit 50 percent of the fines on a pro rata basis to the counties, cities, and towns within the local authority.
Registration fees paid by regulated industries are limited in two ways: 1) registration fees cannot be more than 50 percent of the authorities' supplemental income; and 2) registration fees cannot exceed the cost of specified services provided by the local air pollution control authority.
The authorities' supplemental income comes from a per capita assessment and/or property tax assessment paid by component counties, cities, and towns.
SUMMARY:
One hundred percent of all penalties recovered by the authority are retained and paid into the authority's treasury and credited to its funds.
There is no limitation on the revenues collected from sources of air pollution for services rendered by local air authorities during any fiscal year.

SUMMARY OF PROPOSED SENATE AMENDMENT:
Condominium owners' associations are exempt from the penalty section of the act. The associations are required to cooperate with local air pollution control authorities to acquaint their residents with the provisions of burn bans.
