AS PASSED SENATE, FEBRUARY 24, 1989

BACKGROUND:

Surplus water district property may only be sold upon the unanimous approval of the elected members of a district's board of commissioners.  It has been suggested that this requirement confers an inordinate amount of power upon a single commissioner, and that a majority of commissioners, whether appointed or elected, should be authorized to approve the sale of surplus district property.

SUMMARY:

Surplus water district property may be sold upon a majority vote of the members of a water district board of commissioners.

Appropriation:    none

Revenue:    none

Fiscal Note:      none requested
