BACKGROUND:
Mobile home park tenants may be evicted without cause upon 12 months notice. The cost of moving a mobile home ranges between $1,500 and $7,500 depending on the size of the home and the distance it is to be moved.
There is no requirement, other than the 12 months eviction notice, that a park owner advise tenants of intentions to continue to use the real estate as a mobile home park or to redevelop the site to another use.
SUMMARY:
Lease agreements must contain one of two alternative provisions: either a covenant by the landlord that except for acts beyond his or her control, the mobile home park will not be converted to another land use within three years following the commencement of the lease, or a statement that the park may be sold or otherwise transferred at any time resulting in closure of the park.
This requirement is made to apply to renewals of existing leases or leases entered into after the effective date of the act.
