BACKGROUND:

 

Under the Public Records Act, a public agency cannot give, sell, or provide access to lists of individuals requested for commercial purposes unless authorized by statute.  The automobile industry would benefit from the commercial use of motor vehicle registration lists acquired with agency approval.  This would allow the industry to obtain, particularly for direct mail purposes, valuable statistical information pertaining to servicing, supplies, and other areas of automobile marketing.

 

SUMMARY:

 

A state or local agency may provide lists of individuals requested for commercial purposes when specifically authorized by agency rule.
