BACKGROUND:

 

The Forest Practices Act (RCW 76.09) authorizes the Department of Natural Resources to regulate the state's forest land resources.  Local governments shall not adopt or enforce any law, ordinance or regulation pertaining to forest practices, except in the following areas:  (1) land use planning or zoning authority; (2) taxing powers; (3) regulatory authority with respect to public health; and (4) authority granted by the Shorelines Management Act.

 

SUMMARY:

 

With respect to the Forest Practices Act, local governments may adopt ordinances or other provisions pertaining to wetlands.  All rules must be consistent with forest practice regulations as defined by RCW 76.09.
