BACKGROUND:

 

The criteria for establishing residency in Washington State were established in 1971 with a shift in emphasis from place of residence to the legal concept of domicile.  The burden of proof that domicile has been established in Washington for purposes other than educational lies with the student.

 

SUMMARY:

 

Added to the definition of resident student is the provision for resident status of a person whose spouse has maintained a bona fide domicile in the state of Washington for at least one year prior to registration at an institution of higher education.
