BACKGROUND:
Local governments and private purveyors of water may set requirements for fire flow and the placement of fire hydrants. It has been suggested that the varying requirements between these entities may cause undue delay in development and added costs for consumers.
SUMMARY:
Purveyors of public water are prohibited from imposing fire flow and fire hydrant placement requirements which are more stringent than those imposed by local governments. Purveyors of public water may impose more stringent requirements when those of the local government are less than the minimum performance standards established by the Secretary of the Department of Social and Health Services. A purveyor may accept a water system or portions of a water system that was voluntarily built to specifications that exceed the local government's performance standards.
