BACKGROUND:

 

The statute authorizing an employer to request that a temporarily totally disabled employee be certified to perform available work other than his or her usual work is silent as to whether an employer is required to resume or continue to pay benefits when the employee returns to work under the statute.

 

SUMMARY:

 

Employee benefits which were being received by the employee prior to injury must continue or be resumed when the employee returns to work for the same employer.
